Guest Ticket Terms

These Guest Ticket Terms (the "Guest Terms") apply when you buy a ticket to a club or organisation event through the Comnly platform (the "Service") without holding a Comnly account (a "Guest Purchase"). The Service is operated by Monosphere Ltd (trading as Comnly) ("Monosphere", "we", "us" or "our").
By completing a Guest Purchase you confirm that you have read and agree to these Guest Terms and to the processing of your details described in section 5 and in our Privacy Policy.
If you hold a Comnly account and buy tickets while signed in, the End User Terms apply instead of these Guest Terms.
1. Who you are buying from
1.1 Your ticket contract is with the club or organisation running the event (the "Organisation"), not with Monosphere. The Organisation is the seller and merchant of record. Monosphere provides the technology that lists the event, takes your order and delivers your ticket; we are not a party to the sale and we do not organise, control or supervise the event.
1.2 Your payment is processed by Stripe directly on the Organisation's own Stripe account. Your card details are collected by Stripe on Stripe-hosted pages and are never seen or stored by Monosphere. Monosphere takes no commission on your purchase; Stripe's standard processing fees are the Organisation's responsibility.
2. Your ticket
2.1 Once your payment settles, your ticket (or tickets) are emailed to the address you gave at checkout as a link to a private ticket page showing a QR code. The link and the QR code are your admission credential. Anyone with the link can present your ticket, so keep it private and only share it with the people the tickets are for.
2.2 Admission to the event is managed by the Organisation and is subject to the Organisation's own rules, including any age restrictions, dress codes, membership requirements for parts of the venue, capacity limits and licensing conditions. Buying a ticket does not make you a member of the Organisation and does not give you access to the Comnly app or to the Organisation's member community.
2.3 A ticket is valid for one admission per person. Once scanned at the door it is marked as used.
3. Cancellations, refunds and disputes
3.1 Refunds, cancellations, event changes and disputes are between you and the Organisation. If an event is cancelled, rescheduled or materially changed, or if you want to request a refund, contact the Organisation directly. Refunds, where given, are issued by the Organisation through Stripe back to your original payment method.
3.2 Nothing in these Guest Terms affects your statutory rights as a consumer against the Organisation, including any rights you have under the Consumer Rights Act 2015 in respect of the event itself.
3.3 If you cannot reach the Organisation, you can email support@comnly.com and we will pass your query on where we can, but we cannot issue refunds on the Organisation's behalf and we are not responsible for the Organisation's decisions.
4. Monosphere's role and liability
4.1 Because the ticketing technology is provided to you free of charge and the sale contract is with the Organisation, Monosphere's role is limited to operating the platform, taking your order and delivering your ticket by email.
4.2 We do not exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) anything that, by law, cannot be limited or excluded.
4.3 Subject to section 4.2, we are not liable for: (a) the event itself, including its quality, safety, cancellation, rescheduling or content; (b) the Organisation's conduct or decisions, including refusal of admission; (c) refunds or disputes relating to your purchase; (d) non-delivery or late delivery of a ticket email caused by an incorrect email address, spam filtering or your email provider; or (e) any indirect, special or consequential loss. Subject to section 4.2, our total aggregate liability to you in connection with a Guest Purchase is limited to one hundred pounds (£100).
4.4 Nothing in these Guest Terms affects your statutory rights.
5. Your details
5.1 We collect your name and email at checkout for one purpose: issuing and delivering your tickets and supporting the Organisation with refunds and queries about your order. The Organisation is the data controller for your purchase and Monosphere processes your details on its behalf; see our Privacy Policy for full details, including your rights and how to exercise them.
5.2 You will not be added to any marketing or notification list. Buying a ticket as a guest never signs you up to club communications, Comnly marketing or sponsor content. If you later choose to join the Organisation as a member, that is a separate signup with its own terms and consents.
6. General
6.1 We may update these Guest Terms from time to time. The version shown at checkout when you buy applies to your purchase.
6.2 These Guest Terms and any non-contractual obligation arising from them are governed by the laws of England and Wales. Disputes will be heard by the courts of England and Wales. As a UK consumer, you may also be entitled to bring proceedings in the courts of the part of the UK where you live, and the mandatory consumer protection laws of that part of the UK apply to you.
